Commander in Chief Clause – Constitution Article 2 §2.1

ConstitutionOn Wednesdays we study the Constitution. These days, I’m learning about the second article of seven, which deals with the presidency. Last week I looked at Article 2 §1.8 which contains the presidential oath of office. This week I’m moving on to the second section of the second article. This section begins to enumerate presidential powers. Article 2 §2.1, which gives the president power over the military, is also known as the commander-in-chief clause.

Electoral College at Work (or Not) – Constitution Article 2 §1.3

ConstitutionI’m studying Article 2 of the Constitution, which deals with the Executive branch of government. Last week in Section 1, Clause 2 I looked at how electors are selected for the Electoral College. This week is Article 2 §1.3. It’s about what the electors do. Some people would claim that it threatens the very existence of democratic representation today.

Contracts Clause – Constitution Article 1 §10.1

ConstitutionOn Wednesdays we study the Constitution. Last week I finished Article 1, Section 9 (ostensibly limiting the powers of Congress) with the Emoluments Clause. This week I’m starting Article 1, Section 10, which limits the powers of the states. Article 1 §10.1 is kind of a laundry list, and much of it parallels the powers and limitations of Congress. The Annotated Constitution has 40 pages of case law and interpretation of it’s various phrases. I’ll try to be more concise.
